This page is to ensure transparency in respect to the health of our founding director: Russ McLean. He is still able to work after being hit on the head by a 5,000 ton car ferry (19th April 2019). But the length of time required to rehabilitate has presented challenges. Sadly, the injuries are life-changing and have resulted in a severe alteration of working arrangements.

Within 30 minutes of this photograph being taken by Russ McLean at Brodick Ferry Terminal at around 11.05am on 19th April 2019, a life changing TBI (Traumatic Brain Injury) and stroke requiring lifelong medication were sustained.


Full Disclosure: Epilogue

For the sake of good form and after ingathering sufficient evidence from experience preparing cases for the Procurators Fiscal via a previous occupation…

There followed discussion between Russ McLean and his solicitors alongside specialist Queen’s Counsel (QC).

A decision was made NOT to proceed with litigation against the ferry company CalMac, nor the ferry operator CMAL Ltd.

There was (and still is) ample evidence, photographs, witness statements etc., especially for matters where the statute of limitations do not apply to litigate against the ferry owners and operators.

But following an earlier case which Mr McLean won at the EU and resulted in CalMac having all of its ships and piers removed and placed into the ownership of CMAL Ltd (proceedings relating to the aborted sale of MV Pioneer 2003 to 2007), the management appeared to learn little in the 2003 to 2007 debacle.

The term “won” needs to be qualified as nobody “won” in the 2003-2007 matter. Russ McLean’s company was £30,000 out in legal fees and CalMac/CMAL put a £15,000,000 on their costs.

Why repeat such a futile exercise when that taxpayer funded £15,000,000 would be better utilised employing more NHS staff and teachers and firefighters etc.

Besides, CalMac and CMAL are finally listening to islanders as they have chartered the MV Alfred. for the Arran service. This has undoubtedly saved many jobs and businesses. So credit where it is due at CalMac HQ + CMAL HQ and Transport Scotland. Better to create jobs than litigate endlessly.

Notwithstanding the above notes, there was a worry from Russ McLean that innocent staff and crew would be placed under pressure. This at a time when those very crew and staff were risking their lives keeping the islanders fed and taken care of during the pandemic.

Consequently, Russ McLean instructed his legal counsel NOT to take any further action.

The crews of each ship deserve a management that is capable of running a safe service. After the genuinely brave actions of the crews during Covid, it would be the height of bad form to proceed with litigation where the ferry crew were blamed when the Health and safety legislation specify that responsibility lays with “the directing mind” in these matters.

Subsequently the relief from stress of court proceedings against senior management at CalMac and CMAL has helped the health recovery process.
